These terms govern access to Kenzoria by customers, vendors, and visitors, as well as the use of the marketplace, payment, support, and visibility services made available through the platform.

Introduction

Kenzoria is a Moroccan marketplace operated under the Kenzoria brand by Ste Kenzoria SARL, whose current editorial details are: N° 123, Rue Riad Ouislane 02, Meknès, Maroc, support@kenzoria.com, 06 30 81 06 69, RC: 89028167, IF: 67810982, CNSS: 67810975, Patente: 67810967.

By accessing the website, mobile interfaces, or any service offered under the Kenzoria brand, you agree to these Terms of Use and the related policies referenced by them.

Registration and account

A Kenzoria account may only be used by persons who are at least 18 years old and legally capable of entering into binding commitments.

You must provide accurate, complete, and up-to-date information, keep your credentials confidential, and promptly notify us of any unauthorized access or suspicious use of your account.

  • An account may not be created or used for fraudulent, misleading, or suspension-circumvention purposes.
  • The account holder remains responsible for actions carried out from the account unless a security incident clearly occurred outside the holder’s control.

General sale conditions

Kenzoria provides a technical environment allowing third-party vendors to publish products, receive orders, and interact with buyers.

Unless mandatory law requires otherwise, the sale contract for a product or service shown on the marketplace is entered into directly between the buyer and the relevant vendor.

Kenzoria facilitates matching, offer display, order flow, certain payment operations, notifications, commercial visibility, and dispute support, without becoming the seller of products listed by third parties.

Returns and refunds

Return and refund requests are subject to the Kenzoria returns policy, the relevant vendor rules, and any mandatory rights applicable in Morocco.

Kenzoria may centralize the request, ask for supporting evidence, propose mediation, or execute a platform decision, but the vendor remains responsible for product conformity and sale performance.

Payments

Payments made on Kenzoria may be processed by Kenzoria and/or authorized payment providers. By placing an order, the buyer authorizes the corresponding charge under the selected payment method.

Kenzoria may refuse, suspend, split, or cancel a transaction where further checks are required, in the event of technical failure, suspected fraud, regulatory non-compliance, or a manifest pricing error.

Credits and points

Kenzoria may grant referral points, promotional credits, commercial balances, or equivalent benefits as part of specific campaigns.

Unless expressly stated otherwise, these benefits do not constitute electronic money, are not transferable, do not accrue interest, and do not create a right to cash repayment.

  • Points or credits may be time-limited, capped, suspended, canceled, or adjusted in the event of a return, refund, fraud, or operational error.
  • The balance shown on an account reflects an internal platform benefit and not a bank deposit.

Promotions

Promotions, discounts, coupons, welcome offers, and event campaigns are provided subject to availability, limited duration, and the specific conditions displayed for each campaign.

Kenzoria may withdraw or correct a promotion in the event of a material error, abuse, unauthorized automation, stock shortage, or breach of the stated conditions.

Rules for user content

Depending on available features, users may publish or send reviews, messages, images, descriptions, files, support replies, storefront content, or other materials.

All user content must be accurate, lawful, respectful, non-defamatory, and consistent with the commercial purpose of the platform.

  • Misleading, hateful, violent, obscene, discriminatory, unlawful content or content infringing third-party rights is prohibited.
  • Fake reviews, fake promotions, forged evidence, identity misuse, and rating manipulation are strictly prohibited.

Rights to use content

By publishing or sending content on Kenzoria, you grant Kenzoria a non-exclusive, worldwide, royalty-free license, for the period needed to operate the service, to host, reproduce, adapt, translate, format, display, and distribute that content within the marketplace.

This authorization also covers moderation, support, indexing, fraud prevention, service improvement, and marketplace promotion, subject to applicable mandatory rights.

Use of the website and mobile services

You agree to use the website, mobile pages, progressive web app, forms, any public API, and any other Kenzoria channel lawfully and fairly.

  • You may not disrupt the technical operation of the platform, bypass access restrictions, perform mass scraping, run unauthorized bots, or try to gain unauthorized access.
  • Any attempt at reverse engineering, abusive data extraction, unauthorized load testing, or security exploitation may result in immediate suspension.

Intellectual property

Kenzoria trademarks, logos, visual identity, texts, databases, interfaces, code, audio, visual, and functional elements are protected by applicable intellectual property rights and remain the property of Kenzoria or its licensors.

No substantial reproduction, extraction, commercial reuse, imitation of presentation, or derivative exploitation is permitted without prior written approval.

Data privacy

The processing of personal data carried out when using Kenzoria is described in the Privacy Policy and the Cookies Policy.

By using the platform, you acknowledge that certain data is necessary for order processing, account security, transactional communication, and fraud prevention.

Due diligence and audit rights

Kenzoria may at any time, where reasonably justified, request documents, information, or evidence regarding a user’s identity, product ownership, source of stock, regulatory compliance, tax status, delivery, invoicing, or fraud risk.

Where necessary to protect the marketplace, Kenzoria may conduct or arrange documentary checks, internal reviews, sample controls, activity analysis, or targeted audits consistent with applicable law.

Kenzoria’s role as a marketplace

Kenzoria mainly acts as a digital intermediary and marketplace operator. In that role, Kenzoria organizes offer visibility, the order interface, certain payment flows, exchange history, and mediation or quality-control mechanisms.

By reason of that intermediation alone, Kenzoria does not assume the role of manufacturer, importer, stock owner, or merchant seller of third-party products unless mandatory law provides otherwise.

Limitations and exclusions of liability

To the extent permitted by Moroccan law, Kenzoria shall not be liable for indirect damages, loss of profit, loss of customers, business interruption, data loss not caused by proven gross misconduct, or consequences resulting from the conduct of a vendor, buyer, or third-party service provider.

Kenzoria does not guarantee uninterrupted availability, complete absence of errors, or fitness for every specific purpose, although it implements reasonable security, maintenance, and monitoring measures.

Indemnification

You agree to indemnify and hold harmless Kenzoria, its officers, employees, technical partners, and representatives from any claim, loss, expense, sanction, or damage arising from your breach of these terms, your content, your misuse of the platform, or your products and services offered through the marketplace.

Violation of the terms

If these terms are breached or conduct puts the marketplace at risk, Kenzoria may take proportionate protective measures.

  • Warning, correction request, or temporary suspension.
  • Removal of content, listings, an account, or a store.
  • Blocking orders, freezing promotional benefits, restricting payments, or reporting to competent authorities where required by law.

Entire agreement

These Terms of Use, together with the policies and conditions expressly referenced on the platform, form the entire agreement between you and Kenzoria regarding the covered services.

Order of precedence

If these Terms conflict with a specific Kenzoria policy, the more specific rule will prevail for that specific subject only, without affecting the remainder of these terms.

Modification

Kenzoria may amend these terms to reflect legal, regulatory, technical, commercial, or operational changes.

The updated version takes effect on the date shown on the relevant page. Continued use of the platform after publication constitutes acceptance of the changes, subject to mandatory rights.

Waiver

Kenzoria’s failure to exercise a right or remedy immediately shall not be construed as a waiver of that right or remedy.

Severability

If any provision of these terms is held invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force to the extent permitted by law.

Assignment

You may not assign your rights or obligations under these terms without Kenzoria’s prior written approval. Kenzoria may assign all or part of its rights and obligations to an affiliate, successor, acquirer, or service provider as part of a reorganization or business change.

Third-party rights

Unless required by mandatory law or expressly provided otherwise, no third party may claim a direct right under these terms.

Governing law and jurisdiction

These terms are governed by Moroccan law. Any dispute relating to their validity, interpretation, performance, or termination falls within the jurisdiction of the competent Moroccan courts, subject to a prior attempt at amicable resolution where reasonably possible.
